YOUR CONSENT CHECKLIST
CONSENT MUST BE...
FROM SOMEONE OVER 18
SOMEONE UNDER 18 CANNOT LEGALLY CONSENT TO ANY SEXUAL ACTIVITY. REGARDLESS OF THEIR APPEARENCE OR ATTITUDE TOWARDS SEXUAL ACTIVITY, ALWAYS ENSURE THAT SOMEONE IS OVER 18 BEFORE SEEKING CONSENT.
CONSENT SHOULD BE CLEARLY EXPRESSED. "MAYBE" OR "I'M NOT SURE" DO NOT SUFFICE AS CONSENT TO SEXUAL ACTIVITY. CONSENT SHOULD BE CLEARLY AND VERBALLY EXPRESSED.
SILENCE IS NEVER CONSENT.
CONSENT IS NOT VALID IF IT IS GIVEN UNDER THE INFLUENCE OF DRUGS AND/OR ALCOHOL. IF SOMEONE IS NOT MENTALLY CAPABLE TO CONSENT DUE TO INTOXICATION OR UNCONCIOUSNESS, THEIR CONSENT, EVEN IF IT MEETS THE OTHER REQUIREMENTS, CANNOT BE REGARDED AS VALID. CONSENT MUST BE COHERENT.
FREELY GIVEN + ONGOING
CONSENT SHOULD NEVER BE COERCED OR FORCED. CONSENT IS NOT REAL IF IT IS OBTAINED THROUGH MANIPULATIVE BEHAVIOUR. MOREOVER, CONSENT CAN BE REVOKED AT ANY TIME. IF SOMEONE IS FEELING UNCOMFORTABLE AND ASKS TO STOP, PREVIOUS CONSENT DOES NOT ALLOW FOR GROUNDS TO CONTINUE.
what is underage consent, and is it a valid form of consent?
"underage consent" is consent from soeone who is legally under the age of consent . regardless of whether or not an underage individual gives consent to sexual activity, it is still not consensual. it is not a valid form of consent. consent to sexual activities from a child or underage teenager is not consent, as they are unable to mentally make the decision to consent to sexual activity. if sexual activity is conducted based on underage consent, it is illegal.
what is implied consent, and is it a valid form of consent?
what is intoxicated consent, and is it a valid form of consent?
"intoxicated consent" is consent from someone who is under the influence of drugs or alcohol, making them unable to mentally make the decision to consent to sexual activity. it is not a valid form of consent. if someone is unable to make coherent decisions, they are unable to consent to sexual activity. moreover, if someone is unconcious or sleeping after previously having expressed consent, it does not count as they are no longer concious.
